Privacy Policy for the European Media Extranet

This Privacy Policy applies to the European Media Extranet of Nintendo of Europe GmbH ("Nintendo", "we", "us"), Herriotstraße 4, 60528 Frankfurt am Main, Germany (hereinafter referred to as the "Media Extranet").

Nintendo is a controller as defined in the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 - "GDPR"). Nintendo respects the personal rights of its online users and recognizes the importance of the protection of their personal data.

1. What data do we process and for what purposes?

1.1. Log files

Each time the Media Extranet is used, certain information is transferred from the Internet browser to Nintendo's server, such as the date and time of the visit, the name of the file requested, the web page from which the file was requested, the status (process completed), the web browser and operating system used, as well as the IP address of the device used and the amount of data transferred.

1.1.1 Nintendo uses this information to connect your user device to the Nintendo servers and to enable you to use the Media Extranet. The legal basis for this processing is the provision of the service that you have requested (Art. 6 para. 1 (b) GDPR).

1.1.2 This information is additionally processed for a limited period of time to ensure the security and functionality of the Media Extranet and to prevent attempts to attack our servers. The legal basis for this processing is defined in Art. 6 para. 1 (f) GDPR. The legitimate interest pursued by us is the prevention of fraudulent or illegal activities and the protection of our systems and servers.

You have the right to object to this type of data processing at any time for reasons arising from your particular situation. In order to exercise this right, you may contact us at any time using the contact details mentioned in section 7.

1.2 Registration data

To use the Media Extranet, you must register for the Media Extranet. To register, you must enter the following data: first and last name, organization/company, postal address, e-mail address, telephone number, fax number, type and name of the media for which you work.

We process those data to verify your access to the Media Extranet, to confirm your registration, to enable you to use the Media Extranet and – if you have activated the corresponding optional service – to send you the press release feed via e-mail.

The legal basis for this processing pursuant to this No. 1.2. is the provision of the service that you have requested (Art. 6 para. 1 (b) GDPR).

1. 3 Improvement of our service

Additionally, we process the data collected and processed when you use the Media Extranet and the information that you provide to us voluntarily during registration, such as details of your main interests, in order to analyze the use of the Media Extranet. This allows us to improve and optimize the Media Extranet and our services and make them more user-friendly.

The legal basis for this processing is Art. 6 para. 1 (f) GDPR. The legitimate interest pursued by us in this case is the improvement and optimization of our Media Extranet and our services for the benefit of our users and the provision of a user-friendly product range, the design of which meets the expectations and requirements of the users.

2. Cookies and YouTube Videos

2.1 Nintendo may use cookies on the Media Extranet. Cookies are small files that are downloaded to your computer. Cookies help us to ensure the functionality of the Media Extranet (functionality and session cookies).

Most browsers are set so that they automatically accept cookies. You can prevent the use of cookies or set your browser to notify you when cookies are being sent. If you make use of this option, some areas of the Media Extranet may not function properly.

The functionality and session cookies used by Nintendo are necessary to provide you with the requested services. For example, we use session cookies to allow you to navigate and use the Media Extranet when you are logged in. These session cookies are deleted after your visit. In addition, we use a permanent functionality cookie to save the language setting that you have selected and to enable the Media Extranet to be called up in the language setting you have requested. The legal basis for the use of these cookies is the provision of the services that you have requested (Art. 6 para. 1 (b) GDPR).

2.2 YouTube Videos

The Media Extranet uses the provider YouTube LLC, 901 Cherry Avenue, San Bruno, CA 94066, USA ("YouTube") for video integration. The advanced privacy mode is activated for the videos we integrate. According to YouTube, no information about visitors is stored unless they watch the video. If you click on the video, your IP address will be transmitted to YouTube and YouTube will know that you viewed the video. If you are logged into YouTube, this information will also be associated with your account (you can prevent this by logging out of YouTube before viewing the video).

We have no knowledge and no influence over the collection and use of your data by YouTube that may subsequently take place. 3. Communication with Nintendo

When you send Nintendo an email or other communication, we use this communication to process your requests. The legal basis for this processing is the fulfilment of your request and the provision of the services that you have requested (Art. 6 para. 1 (b) GDPR).

4. Storage period

We will only store your personal data for as long as this is necessary to achieve the purposes for which it was collected or – to the extent that legal retention obligations extend beyond this period – for the duration of the legally prescribed storage period. Your personal data will then be erased.

In particular:

  • If you cancel your access to your registration account, we will erase your personal data.
  • If you exercise your right to object to the processing of your personal data, we will delete your personal data without undue delay unless there is another legal basis for the processing and storage of those data.

5. Transfer of data to third parties

5.1 Depending on your country of origin, we may share your data with our affiliated European companies Nintendo Benelux B.V. and our European subsidiaries in Austria and Switzerland, which provide user support services in connection with the Media Extranet in your country of origin. Your data will be used in accordance with this Privacy Policy and only to the extent necessary for the user support services. The legal basis for sharing your data is the provision of user support services (Art. 6 para. 1 (b) GDPR).

5.2 In accordance with the applicable data protection regulations, Nintendo may disclose your personal data to external processors who act on behalf of Nintendo and provide services in connection with the Media Extranet. If these processors are based outside the European Union, they are either based in third countries for which a European Commission adequacy decision has been issued, or an adequate level of protection is guaranteed by standard data protection clauses issued by the European Commission and concluded by Nintendo and the external processor.

6. Your rights under the GDPR

In particular, you may be entitled to the following rights under the GDPR:

6.1 Right of access: You have the right to obtain confirmation from us at any time as to whether we process personal data concerning you and, where that is the case, access to those personal data. In order to exercise this right, you may contact us at any time using the contact details listed in Section 7. In addition, you can view the data that you have provided at any time in your registration account.

6.2 Right to the rectification of your personal data: When we process your personal data, we take reasonable steps to ensure that your personal data is accurate and current for the purposes for which it was collected. In the event that your personal data is inaccurate or incomplete, you may obtain the rectification of those data. In order to exercise this right, you may contact us at any time using the contact details listed in Section 7. In addition, you can amend your personal data in your registration account at any time.

6.3 Right to erasure or restriction of processing: You may have the right to obtain the erasure of your personal data or the restriction of the processing thereof. In order to exercise this right, you may contact us at any time using the contact details listed in Section 7.

6.4 Right to data portability: You may have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format or to transmit those data to another controller. 6.5 Right to object: You have the right to object to the processing of your personal data as described in this Privacy Policy.

6.6 Right to lodge a complaint with a supervisory authority: You have the right to lodge a complaint with a supervisory authority within the European Union. You may contact the Commissioner for Data Protection of Hesse.
